How we use personal information
Transparency and data protection information
We are committed to clearly outlining our privacy practices so that you can make informed decisions about how Modaes uses your personal data. Any operations, procedures, or technical processes—automated or not—that enable the collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction of personal data or data sets are considered personal data processing activities.
We collect, use, disclose, transfer, and store personal information when necessary to provide our services and to fulfill our operational and business purposes, as described in this Privacy Policy. We encourage you to contact us at any time with questions or concerns about the processing of your personal data by emailing info@modaes.com.
Lawfulness and fairness
We will always request your prior consent for processing your personal data for one or more specific purposes, which will be communicated in advance through an initial information layer and this Privacy Policy. We may also process personal data when there is a contractual or pre-contractual relationship with you, or based on another legal basis.
Data minimization
We only request the data strictly necessary in relation to the purposes for which it is processed, as previously informed.
Storage time limitation
We retain data for as long as necessary based on the processing purpose. We inform users of the applicable retention period in each case. For recurring services, your data will be stored until you withdraw your consent or the contractual or commercial relationship ends.
Confidentiality
We apply appropriate technical and organizational security measures for the processing of personal data, ensuring its confidentiality and minimizing the risk of unauthorized access or misuse of Users' personal data by third parties.
Your Commitment: The Accuracy of the Information You Provide
The user declares that the personal data provided to Modaes is truthful and up to date. Nevertheless, Modaes will keep its databases updated by blocking any data that is unnecessary or ineffective, such as email accounts returned by the server as non-existent or deleted.
Consent for minors
Under no circumstances does Modaes authorize the submission of data by users under the age of 13. If necessary, such submission will require the express consent of their parents or legal guardians, by sending such authorization along with a copy of an identity document to the email address info@modaes.com, as this involves a category of specially protected data.
If Modaes detects the receipt of data from users who may be under the indicated age by any means, it will not process their data nor respond to their requests. Modaes reserves the right to request a copy of the user’s ID or an equivalent document to verify their legitimacy in the event of well-founded suspicion regarding the user's minority status.

Such express consent implies the user's authorization for Modaes to process their data in accordance with the terms set out in this Privacy Policy, as well as by co-controllers and data processors with whom Modaes maintains a contractual and compliance oversight relationship.
International data transfers
In some cases, Modaes uses third-party tools and services to manage this website, as well as for conducting analytics, email marketing campaigns, surveys, etc. Some of these services may be provided by entities located outside the European Union (such as Google, Mailchimp, WordPress, etc.).
Modaes strives to use secure tools whose servers are preferably located in Spain or, failing that, in another EU Member State, or that comply with European data protection regulations, in accordance with the guidelines and recommendations of the Spanish Data Protection Agency, the European Commission, and applicable international data transfer agreements, including certification under the Privacy Shield list.
Most of these third parties declare compliance with the European data protection regulations and even maintain their servers and/or headquarters in Europe. Nevertheless, if an international transfer of data is necessary, your acceptance of this Privacy Policy implies that you explicitly consent to such transfer, having been duly informed.
Security Measures Applied to Personal Data Processing
To protect users' personal data, Modaes ensures—both internally and through its data processors—that appropriate technical and organizational measures are applied in accordance with the state of the art. These measures take into account the scope, context, and purposes of processing, as well as the varying likelihood and severity of risks to data subjects' rights and freedoms, in order to ensure the confidentiality, integrity, availability, and resilience of data processing systems and services.
Modaes confirms its capability to act swiftly and effectively to restore the availability and access to personal data in the event of a physical or technical incident. To this end, Modaes maintains an internal incident log, an incident response plan, and the necessary backup management and control activities to guarantee data recovery in case of a security breach.
Modaes states that it stores users’ personal data in encrypted form on secure servers, protected against common attack vectors and located in Spain, the EU, or, in the case of storage outside the EU, only after verifying compliance with applicable European frameworks (e.g., Privacy Shield or equivalent).
Notification of Personal Data Breaches
In the event of a personal data breach, unless the breach is unlikely to pose a risk to the rights and freedoms of natural persons, Modaes will notify the Spanish Data Protection Agency within 72 hours of becoming aware of the incident. The notification will describe the nature of the breach, its potential consequences, and the measures taken or proposed to address it. Where possible, the notification will also include the categories and approximate number of data subjects and data records affected.
Furthermore, if the breach is likely to result in a high risk to the rights and freedoms of individuals, Modaes will notify the affected data subjects as soon as possible, describing the possible consequences and measures taken or proposed to mitigate the breach.
Exercising your rights
Users may withdraw their consent at any time and/or exercise their rights of access, rectification, erasure, restriction, objection, and data portability as provided under the European data protection regulations. To do so, they must send an email to info@modaes.com or a postal letter to MODAES INFORMACIÓN, S.L.U. (Modaes), at Gran Via de les Corts Catalanes, 690, Local 1, Barcelona, Spain. The request must specify the right being exercised and include a copy of a valid ID document or other identification that proves the user's identity, including electronic identification where applicable.
Right of access

Modaes will respond within one month, unless the request was already made in the past six months or is legally restricted.
Right to rectification
Allows the user to request correction of inaccurate or incomplete data. Supporting documentation is required. Modaes must respond within one month, extendable by two additional months if necessary.
Right to erasure (Right to be forgotten)

Right to object
Users may object to processing based on direct marketing, profiling, or legitimate interest. Modaes must stop processing unless it demonstrates compelling legitimate grounds.

Right to data portability

Modaes will respond to all such requests as soon as possible and, in any case, within one month of receipt. This period may be extended by up to two additional months, with notice provided within the first month.

If Modaes’ rights over the website are transferred to another entity, Modaes commits to establishing an agreement whereby the new data controller assumes this Privacy Policy. If personal data is to be used in a way that conflicts with this policy, users will be notified beforehand.
